The General Assembly, in enacting the Victims Bill of Rights, recognized the civic and moral duty of victims of and witnesses to a crime to cooperate fully and voluntarily with law enforcement and prosecution agencies. The General Assembly further recognized that to ensure that all victims of and witnesses to a crime are treated with dignity, respect, courtesy, and sensitivity, the rights and services extended in the law to victims of and witnesses to a crime are honored and protected by law enforcement agencies, prosecutors, and judges in a manner no less vigorous than the protections afforded criminal defendants. The purpose of this agreement is to maintain a level of service throughout Furman County and the Town of Tree Top as contemplated by the Victims Bill of Rights, S.C. Code Ann. 16-3-1505 et seq. It is agreed that the Furman County Sheriffs Office will provide the Town of Tree Top with the services of a Victim Advocate for the purposes of assistance, notification of release of offenders, notification of court appearances, assistance with reimbursement forms, and other counseling services, as well as the other services mandated by S.C. Code Ann. 16-3-1505 et seq., to be provided by the law enforcement agency. It is agreed that in consideration of this agreement, the Town of Tree Top will provide Furman County with the monies collected pursuant to S.C. Code Ann. 14-1-211 that are maintained by the Town of Tree Top for the purpose of providing services for victims of crime. It is agreed that the monies collected pursuant to S.C. Code Ann. 14-1-211 by the Town of Tree Top and transmitted to Furman County monthly will be placed in the Victim Services Account through the Furman County Treasurers Office just as if those funds were maintained by Furman County through general sessions and magistrates court surcharges. It is agreed that the Victim Advocates will be employees of the Furman County Sheriffs Office at all times even when rendering services within the Town of Tree Top. It is agreed that the Victim Advocates job description(s) will be revised and updated to incorporate additional duties regarding providing services to the Town of Tree Top. Furthermore, with the exception of personnel specifically named in other agreements between these two agencies, this agreement does not in any way render personnel of the Town of Tree Top Police Department as employees of the Furman County Sheriffs Office. It is agreed that the Furman County Sheriffs Office will provide the Town of Tree Top with monthly, quarterly and year-end reports regarding the number of victims, types of victims and services provided to victims on behalf of the Town of Tree Top. It is agreed upon that the Furman County Sheriff Office will provide the Town of Tree Top Police Department with Victim Advocate Brochures and Victim Advocate contact cards. This agreement shall be re-evaluated and signed by all parties annually prior to the expiration date noted below. Also, it shall remain in effect for a period of one year unless rescinded by either party by written notice to the other agency.
